1. Introduction & Binding Contract

Summary: Be honest, respectful, and keep it clean. No fake accounts, no commercial scams, and no malicious behavior.

You agree to handle yourself in accordance with the values of a traditional Albanian home—with dignity, honor, and mutual respect. You are strictly prohibited from engaging in the following actions:

• Misrepresentation: Creating fraudulent accounts, catfishing, falsifying your age, identity, family background, or employment history.
• Financial Exploitation: Soliciting money, loans, bank transfers, or gifts from other users under any pretext, including traditional courtship dynamics.
• Technical Disturbance: Implementing scrapers, crawlers, automated bots, or data-mining scripts to copy member profiles or compromise server infrastructures.
• Security Violations: Sharing access credentials, letting third parties utilize your profile, or attempting to scan the platform networks for vulnerabilities.
• Malicious Harassment: Stalking, insulting, threatening, defaming, bullying, or engaging in unwanted pursuit of platform users on or off the Service.
• Commercial Exploitation: Advertising products, multi-level marketing setups, external link building, sugar-dating arrangements, prostitution, or escort operations.

4. Content Standards (The PG-13 Mandate)

5. Content Ownership & Licensing

3a. Your Content

You retain title and ownership of the text, bio material, and images you upload ("Your Content"). However, by setting up an account, you grant us a worldwide, transferable, sub-licensable, royalty-free, and perpetual license to host, store, copy, modify, translate, and distribute Your Content to other active users for matchmaking purposes. To safeguard your privacy, we will never distribute your private profile images to third-party ad brokers.

3b. Member Content

Content posted by other members belongs exclusively to them. You have a limited right to view this content within the app to judge relationship compatibility. You may not copy, extract, or harvest member photos or use them outside the platform. Doing so constitutes a material breach of this contract.

3c. Our Content

All software, visual graphics, user interfaces, branding configurations, trademarks, logos, and proprietary algorithms belong to Albanian Singles USA LLC. You receive no property or operational rights under this contract, except for a revocable, non-exclusive license to use the app for its intended matchmaking purpose.

6. Identity and Background Verification Warnings

Although our moderation teams perform initial checks against blatant scams and fake accounts, AlbSinglesUSA Dating App does not execute structured criminal background reviews or biometric identity verification files on its users. The verified presence of an account does not equal an endorsement of character, health, background, or physical safety.

You understand that you assume all risks when interacting with individuals online or scheduling real-world meetings. Always execute extreme care, review public social contexts, and follow necessary personal safety protocols before meeting a potential match in person.

7. Subscriptions, Automatic Renewals, and Billing

AlbSinglesUSA Dating App may offer premium matching features, filtering suites, and premium tiers via External Services (e.g., Apple App Store, Google Play Store) or direct in-app internal payment engines. By purchasing a premium tier, you explicitly agree that your subscription will automatically renew at regular intervals (e.g., monthly or annually) and your card will be charged the standard, non-promotional price until you proactively cancel.

Cancellation Procedures: Deleting the application file off your phone does not cancel your subscription billings. You must navigate to your Apple ID or Google Play settings menu and select "Subscriptions" to terminate the auto-renewal configuration. If you purchased directly via credit card on our website, you must cancel inside your account settings dashboard.

8. Complete Refund Policy & State-Specific Cancellation Rights

9. Account Suspension & Termination Rights

10. Digital Millennium Copyright Act (DMCA) Compliance

We respect intellectual property protections. WE PROVIDE NO GUARANTEES CONCERNING THE EXACT NUMBER OF ACTIVE MEMBERS, YOUR ULTIMATE COMPATIBILITY WITH ANY PROFILE, OR THE RELATIONSHIP OUTCOMES CULMINATING FROM THE USE OF THE SERVICE.

12. Limitation of Liability

THIS INCLUDES, WITHOUT LIMITATION, LOST PROFITS, FINANCIAL LOSS, LOSS OF DATA, EXTRACTED GOODWILL, OR INTANGIBLE DEPRIVATIONS ARISING OUT OF YOUR DISCOVERY, USE, OR INABILITY TO USE THE SERVICE, OR THE CONDUCT AND POSTINGS OF OTHER MEMBERS ON OR OFF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ALL DISPUTES SHALL NEVER EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100.00 USD) OR THE EXACT SUMS PAID BY YOU FOR PREMIUM FEES DURING THE PRECEDING TWENTY-FOUR (24) MONTHS.

13. Indemnification Obligations

You agree to fully indemnify, defend, protect, and hold harmless Albanian Singles USA LLC, its corporate owners, and operational employees from any third-party complaints, lawsuits, legal demands, losses, damages, or costs (including court expenses and attorney fees) arising from your direct use of the app, your uploaded content, your behavior toward other platform users, or your structural violation of this contract.

14. Dispute Resolution Process & Mandatory Binding Arbitration

Summary: Any legal dispute must first be handled through an informal conversation. If that fails, it will be settled via binding individual arbitration under Texas law, not a public courtroom lawsuit. You waive your right to a jury trial or class action.

YOU AND AlbSinglesUSA Dating App MUTUALLY AGREE TO WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO LITIGATE AN APP DISPUTE INSIDE A PUBLIC COURTROOM. RECOURSE MUST BE COMPLETED ON AN INDIVIDUAL BASIS. YOU ABSOLUTELY WAIVE THE RIGHT TO COMMENCE, JOIN, OR PARTICIPATE IN ANY CLASS ACTION LAWSUIT, CLASS-WIDE ARBITRATION, COLLECTIVE LITIGATION, OR PRIVATE ATTORNEY GENERAL LITIGATION INVOLVING THE PLATFORM.

15. Governing Law & Forum Selection

This contract, your platform interaction, and all associated legal claims are governed completely by the laws of the State of Texas and the Federal Arbitration Act, without regard to conflict of law frameworks. If a claim escapes arbitration for any verified exception, you explicitly agree that exclusive jurisdiction and venue for litigation belongs in the state or federal courts situated in Dallas County, Texas. You waive any arguments regarding an inconvenient forum.

16. Entire Contract & Sever-ability Rules

These Terms, along with our Privacy Policy, represent the complete, final, and total contract between you and Albanian Singles USA LLC concerning your platform usage, wiping out all prior written or oral agreements. If any clause, paragraph, or phrase within this contract is adjudicated as illegal or unenforceable by an arbitrator or court, that specific element will be severed, and the remaining provisions of the contract will maintain absolute validity and binding legal force.
